Do Not Move Land Boundary Markers in Thailand

หมุดหลักเขตที่ดินกับแปลงที่ดิน / Land boundary marker and a plot of land

Moving fences, poles or land boundary markers to make your land bigger is a criminal offence in Thailand. Under Section 363 of the Thai Penal Code, the penalty is up to 3 years in prison, a fine of up to THB 60,000, or both.

Why moving a boundary marker is a crime

Section 363 of the Thai Penal Code makes it an offence to move or destroy, in whole or in part, the boundary markers of a piece of land in order to take someone else’s land for yourself or for another person.

Boundary markers are not only survey pegs. Fences, poles and anything else used to mark where a plot of land ends can count too.

Penalty

  • Up to 3 years imprisonment
  • or a fine of up to THB 60,000
  • or both

What if you believe the land is yours?

Even if you believe the land is yours, do not move the markers yourself. Only the land authorities may set or change land boundaries.

Frequently asked questions

Is moving a fence or pole also an offence?

It can be. If the fence or pole marks the boundary of the land and you move it to increase your own land, it may fall under Section 363.

What is the maximum penalty?

Up to 3 years in prison, a fine of up to THB 60,000, or both.

What should I do if a marker is missing or the boundary is unclear?

Do not place or move markers yourself. Contact the Land Office so officials can handle it, and speak to a lawyer first if you are in a dispute with a neighbour.
